What could you be paid?
Not payable yet. The announced program includes benefits up to $1,000 weekly when benefits begin; implementation guidance should be rechecked before a future claim.
Who may qualify?
The future program generally uses 680 hours of Maryland-localized work in the relevant four quarters. Existing employer benefits and current leave protections still need a separate review.
What protects your job?
Future FAMLI is intended to provide job-protected leave. For a baby arriving before launch, check current FMLA, Maryland parental-leave requirements and employer policy rather than relying on future benefits.
Recovery leave and bonding
The future program covers medical as well as family reasons. Until payments launch, investigate an existing disability policy and any employer-paid recovery benefit.
Notice, dates, and deadlines
Benefits are scheduled for January 1, 2028. Contributions begin in 2027. Some late-2027 births may allow bonding after launch within the first year; the agency must confirm eligibility.
How to apply
There is no 2026 FAMLI benefit to claim. Use Maryland FAMLI for implementation updates and plan current leave with HR.
Other rights and public-employee benefits
Before the broad FAMLI launch, some parents have other rights now. Maryland’s parental-leave law can provide six weeks of unpaid leave for eligible workers at employers with 15 to 49 employees. Eligible State Executive Branch employees have a separate paid family and medical-leave benefit that began July 1, 2026. These current options should not be confused with the statewide insurance rollout in 2028.
Before you choose your dates
Ask for one written timeline showing the source of pay and the protection for each part of your absence. Include prior leave used, any waiting period, employer top-up rules, health-premium payments, and the first scheduled workday after leave. The maximum listed above is not a personal approval.
Your application folder
- Employer contact, work location, hire date, wage records and schedule.
- Proof of birth or placement accepted by the program.
- Medical certification only when the requested leave reason requires it.
- Proposed dates, any split schedule, and the employer’s notice confirmation.
- Submitted forms, receipt numbers, decisions, and appeal deadlines.
After approval, check whether continuing certifications or weekly claims are required. Report work, other payments and date changes accurately. A state payment approval does not automatically update the employer’s absence record.
